Terms of Service — What You Should Know
- Using the Site or engaging Sniff Test means you agree to these Terms unless we execute a separate written agreement that expressly supersedes a provision.
- You must supply accurate information, arrange lawful and safe building access, supervise our personnel as your rules require, and comply with laws and agreements that apply while we work on site.
- Fees, taxes, invoicing, cancellation rights, and scope changes are set out in quotations and contracts—not only on this page.
- Reports and sensor data support operations; they are not legal advice and do not guarantee actions by regulators, tribunals, or insurers.
- Liability caps and certain damage exclusions apply where Ontario law permits, as described in Section 11.
- We may update these Terms; posting a new version with an updated effective date is notice unless the law requires more for your situation.
These Terms of Service ("Terms") govern use of snifftest.ca (the "Site") and Sniff Test's odor detection and related services in Canada. By browsing the Site, requesting information, or entering into an engagement with us, you agree to these Terms. If you act for an organization, you represent that you have authority to bind it. Privacy practices are described in our Privacy Policy.
1. Services
Sniff Test delivers cigarette, cannabis, and vaping odor-detection and triangulation engagements for condos, rentals, workplaces, campuses, and similar multi-tenant premises, including consultations, sensing plans, installation coordination, monitoring where contracted, stakeholder documentation, reporting, and post-install support.
Commercial scope—including milestones, exclusions, escalation paths, travel, standby billing, interoperability requests, and coordination touchpoints—is spelled out in quotations and signed agreements.
We may refresh how we describe or bundle offers on the Site while honoring active contracts.
2. Eligibility
The Site targets professional adults tasked with commissioning or overseeing building operations. Persons who place binding orders represent they have reached at least the age of majority applicable to them and hold authority on behalf of the applicable organization.
3. Your Responsibilities
You keep contact directories, escalation lists, invoices, and contractual notices accurate. You coordinate lawful access—including keys, fobs, escorts, elevator bookings, hoarding, shutdown notices, and safety disclosures that apply before Sniff Test teams enter restricted or hazardous areas.
You remain responsible for channels you designate for coordination (for example corporate email aliases or mobiles used for outages).
4. Acceptable Use
You agree not to use the Site or services to:
- Violate law, harass others, infringe intellectual property, or distribute malware.
- Interfere with systems or equipment belonging to Sniff Test, the premises we serve, responders, or utilities when that interference harms safety or reliability.
- Attempt unauthorized access, credential stuffing, security testing, or abusive automated scraping without Sniff Test's prior written coordination.
- Misrepresent affiliation with a premises, impersonate Sniff Test staff, falsify measurements, or sabotage hardware Sniff Test installs.
We may suspend Site access or field work for violations or unacceptable risk.
5. Materials You Provide
- You retain ownership of materials you voluntarily share.
- You grant Sniff Test a limited licence to store, copy, analyse, transmit, and display those materials solely to deliver requested services, invoice, evidence compliance, operate the Site, and create aggregate statistics that do not identify individuals or suites.
- You represent that sharing those materials does not violate law or agreements binding you.
6. Building Occupants and Third Parties
- Authorized representatives coordinate Sniff Test's work. Residents, tenants, employees, and visitors should follow notices from condominiums, landlords, employers, insurers, or regulators that apply to them.
- Sniff Test is not responsible for independent decisions those parties make about data they collect or enforcement they pursue outside our written scope.
7. Fees and Payment
- Paid services require fees set out in quotations, purchase orders, or invoices, including applicable taxes unless stated otherwise.
- Amounts are non-refundable except where law or a written promotion expressly provides credit or reimbursement.
- Failure to pay may lead to suspension, termination, collection, or contractual remedies we are permitted to exercise.
8. Intellectual Property
- Sniff Test retains rights in the Site, branding, software, analytics models, documentation, and related IP except as expressly licensed.
- Unless we grant a wider licence in writing, you may not copy, modify, reverse engineer, circumvent technical controls, or create confusingly similar marks.
9. Termination
We may suspend or stop work if you:
- Breach these Terms or applicable law.
- Fail to pay required fees.
- Create material risk to health, safety, security, or Sniff Test's reputation.
You may discontinue unpaid Site browsing at any time. Paid engagements end according to their contracts; contact info@snifftest.ca for servicing or wind-down questions.
10. Disclaimers
- Services and the Site are provided "as is" and "as available."
- We do not guarantee uninterrupted or error-free operation.
- We are not responsible for third-party systems, building conditions outside agreed scope, or enforcement decisions by authorities.
11. Limitation of Liability
To the fullest extent permitted by law:
- Sniff Test is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
- Total liability for any claim will not exceed the fees you paid to Sniff Test in the twelve (12) months before the event giving rise to the claim.
12. Changes to Terms
We may update these Terms periodically. Material changes may be communicated by email to active clients or prominent Site notice when appropriate. Continued use of the Site after updates means acceptance except where law requires a different process.
13. Governing Law
These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law principles, and parties attorn to the courts of Ontario except where consumer protection rules elsewhere mandate otherwise.
